Thepowertool Pty Ltd A.C.N. 142 139 740 (we, us, our or thepowertool) recognise that there may be circumstances where you wish to cancel your subscription (Subscription) to the myloop System (the System).

Please read our Cancellation and Refund Policy carefully to ensure that you are fully aware of your rights and our obligations to you with respect to cancellations and refunds.

Cancellation Of A Subscription By You

Cancellations of a Subscription must be advised in writing to, or by logging in to thepowertool website (the Website) and following the steps required therein. Your subscription will cease at the end of the month following the month in which you unsubscribe. You will be required to pay the usual subscription costs for the month following the month in which you unsubscribe. No other cancellation charges will be required or payable.

Cancellation Of A Subscription By Us

We reserve the right to cancel a Subscription in the event that you breach the terms of use, upload terms, user agreement, purchase terms, or for any other reason including breaking the law of any country from which you access the System.

If we cancel a Subscription, you will not be entitled to a refund of any amounts already paid. You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from such cancellation.

We are not responsible for any incidental expenses that you may have already incurred as a result of your Subscription, such as bank fees and charges.

Unpaid Accounts

Your account falls into arrears if you have not paid the required subscription fee by 5:00pm on the first day of a subscription period. If you fail to pay the amount that is in arrears by 5:00pm on the last day of that subscription period, you will be denied access to your data from that time. You will regain access to your data upon payment of your arrears.

If you fail to make payment of your arrears within 2 months of falling into arrears your account will be closed.
